GENERAL CONTRACTING CONDITIONS

These General Contract Conditions apply to the purchase of products that the entity CASA HERNANZ S.L. (hereinafter “CASA HERNANZ”), sells through the website of its ownership hosted at the URL www.casahernanz.es (hereinafter, “the Web”) to any Internet user who places an order (the / the “Customers”).

By placing a purchase order through the Web, the Client declares to be of legal age and have the legal capacity to contract the products offered on the Web. For this purpose, CASA HERNANZ reserves the option to request from the Client, at any time, documentation proving his age. In the event that CASA HERNANZ verifies that the Client is not of legal age or that he does not comply with the request of CASA HERNANZ, totally or partially, CASA HERNANZ will prevent him from contracting the requested product.

The General Contracting Conditions apply only to purchases of products made by Clients through the Web and, consequently, will not apply in the event that Clients buy products from third parties or in the physical store located at Calle Toledo 18, 28005 Madrid.

The purchase of the products offered through the Web implies the acceptance of the terms and conditions of the General Contracting Conditions, therefore, before proceeding with their acceptance, read their content carefully. If you do not accept the General Contracting Conditions, the purchase of the products will not take place and, consequently, it will not entail the assumption of any type of obligation and / or responsibility on the part of CASA HERNANZ.

  1. HOW TO PLACE AN ORDER

 

To place an order you need an email address and you must expressly accept the installation of cookies at the time the corresponding cookie notice is displayed when you visit the Web for the first time or, where appropriate, configure your browser to accept cookies and pop-ups to be able to use all the functionalities of the Website, which includes adding products to your shopping cart or completing a purchase, among others.

 

The process of contracting, buying and placing an order on the Web is simple and consists of the following steps that can be completed in Spanish or English:

  1. Complete the online purchase process.

  1. PRICE AND PAYMENT METHOD

 

The price of the products will be the one that appears expressed in Euros on the Web and will include VAT and / or, where appropriate, any other tax and / or rate that is applicable in the applicable territory. Shipping costs are calculated once the Customer has entered the shipping address of his order.

 

CASA HERNANZ may offer discounts within the framework of certain promotions, although these discounts will not be cumulative with other promotions.

 

CASA HERNANZ reserves the right to make, at any time, the modifications it deems appropriate on the prices of the products. In any case, the price applicable to the purchase order made by the Client will be the one that appears at the time of accepting these General Contracting Conditions with respect to the selected product.

 

When placing the order, you will be able to pay for the purchases you make by paying with a debit or credit card (Visa, MasterCard, 4B, 4B-Mastercard, Maestro, Multibank and other Red 6000 cards issued by Savings Banks).

 

The cost and expenses of the products ordered will be charged to your account at the time the Customer confirms the order. We will process the Client’s order when the issuer of his card authorizes the corresponding payment.

 

If the issuer of your card refuses to authorize the payment for any reason, we will not accept your order and, consequently, we will not assume any responsibility for the delay of delivery, or for the non-delivery of the product or as for no other aspect.

 

CASA HERNANZ is not obliged to inform the Client about the reason for the rejection. In order to guarantee the greater security of our clients, we reserve the right to request, if we consider it necessary and prior to the delivery of the order, a photocopy of the buyer’s identity card for all payments by bank card.

 

  1. SHIPMENTS

 

CASA HERNANZ will send its products to the place indicated by the Client during the purchase procedure as long as it is within Spain, Portugal (Peninsular), Italy, France, Germany, Belgium and the Netherlands.

 

For shipments outside of Spain, Portugal (Peninsular), Italy, France, Germany, Belgium and the Netherlands, please contact CASA HERNANZ directly at casahernanz@hotmail.com.

 

The transport company in charge of shipments at CASA HERNANZ is Correos España.

 

Any order received during the weekend (Friday from 2:00 p.m., Saturdays and Sundays) will be considered as placed the next business day.

 

–  How long do shipments take?

 

Once order is confirmed on the Web, you will receive it from 2 to 5 working days (Spain – Peninsula).

 

Shipments to the Canary Islands, the Balearic Islands, Ceuta, Melilla and Portugal may be delayed a few more days.

 

For shipments to Italy, France, Germany, Belgium and the Netherlands, the delivery period is 4 to 10 working days.

 

Correos España will inform the customer of the status of the order by SMS or e-mail.

 

Casa Hernanz is not responsible for delays caused by customs or on specific dates when transport services have a high volume of work.

 

– How much do shipments cost?

 

The cost of the shipments will be the following (in case there is no current promotion in this regard):

 

  • Shipments to Spain (Peninsula): 5.00 euros.

 

  • Shipments to the Balearic Islands: 8.00 euros.

 

  • Shipments to Ceuta and Melilla: 10.00 euros (in orders less than 150.00 euros in which it is not necessary to issue DUA) *

 

  • Shipments to the Canary Islands: 10.00 euros (in orders less than 150.00 euros in which it is not necessary to issue DUA) *

 

  • Shipments to Portugal have a cost of 7.00 euros.

 

* In the case of shipments to the Canary Islands, Ceuta and Melilla in which it is necessary to issue a Single Administrative Document (DUA), this amount will be borne by the Customer and will be added to the corresponding shipping costs. Likewise, clients will bear the corresponding customs and / or import expenses.

 

Shipments to Italy, France, Germany, Belgium and the Netherlands have the following cost, depending on the weight of the products shipped:

o from 0 to 5 kilos: 18.00 euros

o from 5 to 10 kilos: 26.00 euros

o from 10 to 20 kilos: 36.00 euros

–           France

o from 0 to 5 kilos: 16.00 euros

o from 5 to 10 kilos: 22.00 euros

o from 10 to 20 kilos: 27.00 euros

–           Germany

o from 0 to 5 kilos: 16.00 euros

o from 5 to 10 kilos: 21.00 euros

o from 10 to 20 kilos: 26.00 euros

–           Belgium

o from 0 to 5 kilos: 17.00 euros

o from 5 to 10 kilos: 23.00 euros

o from 10 to 20 kilos: 33.00 euros

–           Netherlands

o from 0 to 5 kilos: 17.00 euros

o from 5 to 10 kilos: 25.00 euros

o from 10 to 20 kilos: 35.00 euros

 

–           Pick-up at the store

 

The collection of the order in store (Calle Toledo 18, 28005 Madrid) will be free. Client will indicate his name and order number. It will also be necessary to show the confirmation email of the order.

 

If the Client only comes to the store to pick up the order, he can enter directly and ask about his order. You will not need to wait in line, if there is one at the time. In this case, it will not be possible to open the package to test the products in the store or make any other purchase.

 

  1. RETURNS AND EXCHANGES

 

The Client may return the purchased products within a period of 14 calendar days from reception, according to the tracking number that CASA HERNANZ provides. After this period, CASA HERNANZ will not return the amount paid nor will replace the product with another.

 

Products made in esparto are not eligible for changes and / or returns.

 

To make an exchange, the Client will have to return their purchase and place a new order with the style and / or size they need.

 

To correctly process the return, the product must be in perfect condition, without any type of damage or signs of use and in its original packaging.

 

Once CASA HERNANZ receives the product and analyzes it, the Client will receive a confirmation email.

 

You can make your return in the following ways:

 

– Return the item to our store

 

The Client must go to CASA HERNANZ store and hand the product to be returned together with a copy of the invoice and showing the “Order Confirmation” email.

 

Once CASA HERNANZ reviews the item and confirms that it is in the appropriate conditions for its return, it will process the refund of the amount.

 

Once the return is approved, the Client will receive an email informing of the refund. The time schedule in which this will be effective will depend on the Client’s bank. CASA HERNANZ is not responsible for any delay that occurs in this process.

 

Return on behalf of the Client

 

The Client may send the items he wants to return with the transport company he chooses. Shipping costs will be borne by the customer. The products must be sent to the following address:

If the Client chooses this option, they must first write to casahernanz@gmail.com so that CASA HERNANZ has knowledge that they will receive the Client’s article.

 

The Client must include the invoice in the package sent so that CASA HERNANZ can identify the shipment once it receives it and, thus, be able to start the return procedure.

 

The refund of the price paid by the Client will be carried out once CASA HERNANZ has received the package and has verified the good condition of the items. Once the return is approved, the Customer will receive an email informing of the refund. The time schedule in which this will be effective will depend on the Client’s bank. CASA HERNANZ is not responsible for any delay that occurs in this process.

 

CASA HERNANZ is not responsible for shipments made by the Client if they are not delivered to our address or get lost

 

PRODUCTS MADE IN ESPARTO

 

Products made in esparto have a series of specialties:

 

– The shipment will be managed when we actually have the ordered product. In this case, if the Client wishes to buy some other product that falls in the general shipping regime, we recommend buying the products separately since, otherwise, all the products will be sent when the esparto product is ready. In this case, shipping may take about 3 weeks, which is the approximate manufacturing time.

 

– As this is a product made to order, CASA HERNANZ does not accept changes and / or returns of products made in esparto.

 

  1. PRODUCT CARE

 

A significant part of our products are made of natural leather, which can mean that the surface is not completely smooth and uniform, and small imperfections that are typical of leathers that are treated and manipulated in a natural and traditional way, may be visible.

 

In addition, since the leather we use is dyed using traditional methods, any irregularity or difference in appearance is considered an intrinsic characteristic of the product.

 

To preserve the original quality of the product, avoid exposing it to extreme heat and humidity. Rain, rubbing and direct sunlight can cause discoloration or staining. Avoid contact with corrosive substances such as oils and alcohol.

 

The sole of our espadrilles are made from natural jute. As jute is a 100% natural and vegetable fiber, contact with water is not recommended (except if you are in the process of washing them). Contact with water does not damage them by itself, what damages the product is if it gets wet and you keep walking and using it. Therefore, on days with a forecast of rain, we recommend that they are not worn in order to avoid their deterioration.

 

In case espadrilles get wet or damp, we recommend removing them as soon as possible so that they can dry completely before being used again. This way we try not to deteriorate the sole completely and can continue to enjoy them.

 

If you want to wash them, nothing happens if the jute gets wet, since once you finish washing them, they will not be used as they must be completely dry before using them again to avoid deterioration of the vegetable fiber (jute). Keep in mind that, even on hot summer days, it can take up to 4 days for the sole to be completely dry.

 

Drying must be done in a ventilated space, but without direct sunlight, since direct exposure to the sun deteriorates the fabric and causes stains and discolorations.

 

  1. REFUSAL TO PROCESS AN ORDER

 

CASA HERNANZ reserves the right to withdraw any product from the Web at any time and / or to remove or modify any material or content thereof.

 

Although CASA HERNANZ will do everything in tis power to always process all orders, there may be exceptional circumstances under which the processing of an order must be rejected after having sent the “Order Confirmation”, and we reserve the right to do so at any time, at our sole discretion.

 

CASA HERNANZ will not be liable to the Client or to any third party for removing any product from the Web, regardless of whether said product has been sold or not, for removing or modifying any material or content on the Web, or for deny the processing of an order once you have sent the “Order Confirmation”.

 

 

  1. LIABILITY

The color of the products that appear on the Web may vary depending on the characteristics of the Clients’ devices. To this end, CASA HERNANZ reserves the right to rectify the images of the products when necessary.

CASA HERNANZ will not be responsible for errors that may occur in the delivery of the products in the event that the Client has not correctly completed the purchase form enabled on the Web. If there is any incident in the delivery of the products, CASA HERNANZ will inform the Client of this as soon as it becomes aware of it.

  1. PERSONAL DATA

When making a purchase through this website, CASA HERNANZ will ask the Customer for their personal data necessary to process the order. Specifically, customers must provide their real name, real and complete shipping address, phone number, and email address.

Likewise, CASA HERNANZ will ask the Client to provide the data related to the payment, guaranteeing that said payment data is valid, correct and exact. The Client must confirm that he is the person mentioned in the billing information he provides.

When placing an order, the Client expressly authorizes CASA HERNANZ to carry out a data verification and, when CASA HERNANZ deems it necessary, to communicate or obtain information from third parties (including any updated information) about the Client, including, but not limited to , to the number of your credit card to validate it, obtain the initial authorization of the same and be able to authorize the purchase operation.

The Customer’s order will be binding when he has clicked the “Place Order” button at the end of the order process. By pressing this “Place Order” button, the Client is placing the order that is shown on the final screen of the purchase process. When CASA HERNANZ has received the order, an automatic confirmation of receipt will be displayed on the Web that will contain the order number and the information of your purchase. At that time the purchase contract will have been formalized.
